We may change these terms at any time by posting the changed version on the Site; the date at the top tells you when. Continued use after a change is acceptance of it. We may change, suspend or remove any part of the Site, including the demo websites, without notice. We do our best to keep information current but do not promise that any page is complete, accurate or up to date, and we are not liable for reliance on out-of-date content.
We grant you a non-exclusive, revocable, non-transferable licence to access and use the Site for the purpose of learning about and purchasing our services. You must not copy, scrape, frame, republish or commercially exploit any part of the Site; use it to build a competing offering; reverse-engineer the demo websites, their code, documents or quizzes; or infringe our or anyone else’s intellectual property.
The twelve demo businesses on the Site are fictional. Their names, people, reviews, prices, availability and statistics are invented to show what a finished setup looks like. Nothing on a demo is an offer of services, and forms submitted on a demo are not received by any real business. Quizzes, calculators and the regulatory change log are general guides only, may be simplified or out of date, and are not advice about your circumstances.
You must not use the Site to do, or help anyone else do, anything unlawful, defamatory, harassing or threatening; attempt to gain unauthorised access to the Site, our systems or other users’ data; introduce viruses or malicious code; submit false information in forms; or send unsolicited commercial messages using information from the Site.
Content on the Site is general information about starting and running a business. It is not legal, financial, tax, accounting or regulatory advice, and it does not create a client, adviser or fiduciary relationship. A relationship with Nemco begins only when a written quote or order is accepted under our Terms & Conditions. Confirm requirements with the relevant regulator or a qualified professional before acting.
All content on the Site – text, design, graphics, logos, code, documents, sample documents, quizzes and demo websites – is owned by or licensed to Nemco and protected by Australian and international law. Sample documents are watermarked previews supplied for evaluation only. You may not reproduce, distribute, modify or create derivative works from any of it without our written permission, except as permitted by law.
Where you submit content to the Site (forms, quiz answers, enquiries, messages), you grant us a non-exclusive, royalty-free licence to use it to respond to you, deliver services and improve the Site. You warrant that you have the right to submit it and that it does not infringe anyone’s rights. We handle personal information under our Privacy Policy.
The Site links to regulators, government portals, software providers and other third parties. We do not control and are not responsible for their content, availability, accuracy or privacy practices. A link is not an endorsement.
To the extent permitted by law, the Site is provided “as is” and we exclude all warranties that it will be uninterrupted, error-free, secure or free of viruses. We are not liable for any loss or damage – including loss of profit, revenue, data or opportunity – arising from use of or inability to use the Site or reliance on its content. Where liability cannot be excluded, it is limited, at our option, to resupplying the relevant information or paying the cost of having it resupplied. Nothing in these terms excludes rights under the Australian Consumer Law that cannot be excluded.
You indemnify Nemco against any claim, loss or expense arising from your breach of these terms or your unlawful use of the Site.
We may restrict or terminate your access to the Site at any time without notice. Sections 6 to 10 survive termination. If any provision is unenforceable it is read down or severed without affecting the rest.
These terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of its courts. We make no representation that the Site is appropriate or available for use outside Australia.
